Elderburn Lodges in Fife | Terms & Conditions

CONTRACT

The parties to this contract are the lead guest (hereinafter referred to as “you”) and the owner for the sole purpose of a Holiday let of one  or more of the above lodges (hereinafter referred to as “the property”) The contract will be deemed to have been made

  • on receipt of the required payable deposit from you or authorised third party

and

  • confirmation of receipted deposit  to you  by email or first class post from the owner.

Any third party nominated by you will only have authority to communicate with the owner regarding the contract when you have notified the owner in writing.

Nothing in these terms shall be construed as creating any form of tenancy, lease between the parties or licence to occupy the property.  You are prohibited from subletting the property.

This contract may not be assigned or transferred by you to any other party.

PAYMENT

A non-refundable deposit of 30% of the rental is payable on booking subject to a minimum sum of £100.  The balance of the rental is payable no later than eight weeks prior to the commencement date of the let and in the event a booking is reserved within eight weeks of commencement date,  the entire rental is payable on demand. In the event you do not effect payment within either of these time frames, the contract will be treated as terminated and the deposit retained without condition or qualification. A deposit will only be refunded in the event there is unforeseen circumstances beyond the owner’s control preventing their performance of the contract.

Payment can be made by debit or credit card online using our booking system on our website, by bank transfer or by cheque. Cheques should be made payable to “A&J Orr”, trading as Elderburn Lodges, and sent to 5 Elderburn Lodges, Denhead, St Andrews, Fife, KY16 8PA. You are liable for the cost of any bank charges incurred in implementing any bank transfer / cheque processing.

On payment of deposit you will also provide details of a credit or debit card, the owner will retain on file for the purpose of charging to same any costs incurred and occasioned by damage or for additional cleaning and/or refuse removal necessary on or after your vacation of the let.

VAT at the current rate is included.

ILLNESS AND CURTAILMENT

If guests were to fall ill and be unable to travel home, resulting in an extended stay beyond the contracted upon let, you will be responsible for paying for the additional nights in full, on a pro-rata rate. Payment for these nights must be made on immediate demand by the owner failing which and in addition, a late penalty fee of £50 per additional night is chargeable.

CANCELLATION

In the event that you have to cancel your booking and irrespective of the date of intimation of cancellation, the deposit will not be refunded to you.

In the event you cancel out with eight weeks of commencement date only the deposit will be retained and any additional payment taken, reimbursed to you within seven days.

In the event you cancel within eight weeks of commencement date, 100% of the amount of your stay as contracted upon if not already paid will be due and charged to your nominated credit or debit card aforesaid. If the full amount has already been paid this will all be retained.

We strongly recommend that you take out holiday cancellation insurance to protect against unforeseen circumstances.

PERIOD OF HIRE

Your lodge will be ready for you by 4pm on the day of arrival and must be vacated not later than 10am on the day of departure. Early arrival and later departure are by prior arrangement only.

Please note that late departure will incur a charge of £45 per hour, which will be charged to your credit/debit card. Should you fail to return the keys to the property for whatever reason you will incur a charge of £150 to your nominated credit or debit card.

We will be available on site to meet you between the hours of 4pm and 6pm on your arrival date. If arriving outside of these times please contact us as soon as possible to advise, and to make alternative arrangements for keys to be collected.

We cannot be held responsible for properties not being ready for occupation should clients arrive earlier than 4pm.

NUMBER OF GUESTS PER PROPERTY

The number of persons occupying a property must not exceed the maximum number stipulated and agreed on at the time of booking. We reserve the right to terminate the let  without notice if this condition is breached.  For the avoidance of doubt a child aged from two whether or not sleeping in a cot will count towards the number of guests in occupancy.

 Any third parties invited to the property as your guests will be prohibited from staying therein overnight.

ELECTRIC VEHICLE CHARGING & PARKING

There is charging available onsite via two EV points for guests on a pay-as-you-go basis, located in the main car park. Please be aware that charging via any cable direct from the property is prohibited and the cost of any damage occasioned thereby will be charged to your nominated debit or credit card retained on file.

Cars limited to a maximum of two per lodge must be parked in the Lodge’s designated parking space.

HOT TUB

For guests staying in lodges with hot tub facilities any departure from the specific instructions provided for its use in the property and which has resulted in damage requiring additional maintenance, repair and /or refill costs occasioned thereby will be charged to your nominated debit or credit card. The Hot tub must not be used after 11pm any evening – weekday or weekends. Reference is made to the Hot tub terms and conditions of use attached to this contract and incorporated herein.

SMOKING POLICY

Guests are reminded that all of the lodges are strictly non-smoking to ensure the comfort of all our guests. All traces of smoking must be removed from patios/gardens etc by you by the end of the let. A £200 deep cleaning charge becomes payable by you should there be any evidence of smoking remaining in the property.

PETS

No pets or animals are permitted on the premises with the exception of registered assistance dogs in Lodge 6 only. This must be approved in advance and an additional charge applied. Anyone found to have pets in lodges will be charged a fee of up to £200 for a deep clean for the comfort of future guests.

ITEMS INCLUDED IN CONTRACT PRICE AND ADDITIONAL

Your lodge is fully serviced for your arrival. If you wish to have additional servicing during your stay this can be arranged for an additional charge and  please contact the owner at least seven days  prior to your arrival to request it.

A travel cot is available at a cost of £15 per week and a high chair at £10 per week and must be requested at time of booking. Due to a limited number of these items availability is not guaranteed. Please note that cot linen is not included.

PERSONAL INJURY & LOSS OF CLIENT PROPERTY

Your vehicle(s), accessories and contents, and any personal belongings you leave in the property after your vacation are left entirely at your own risk. The owner has no liability to compensate you for any theft, damage to or misplacing of your personal belongings during the holiday let.

CIRCUMSTANCES BEYOND OUR CONTROL

At the time of booking you will be given the name of the property reserved for you. However, the owners reserve the right to allocate an alternative and proportionate property in line with your original request and booking,  

If for any reason a lodge has been rendered unsuitable for occupation during your reserved holiday letting (e.g. water damage/fire damage, break down of heating system etc,) the owner will endeavour to offer you alternative accommodation or an alternative holiday let period. In the event neither is acceptable, you will be refunded all monies paid including the deposit sum.

PROHIBITED MATERIALS

The use of drones is not allowed without our express written permission.  Similarly fireworks are only permitted as authorised by the owner. Night lanterns are prohibited as are any inflammable and/or explosive material within or in close proximity to the property.

ANTI SOCIAL BEHAVIOUR

The holiday let shall not be used for any illegal /immoral purpose or for any trade or business.

Home entertainment equipment, musical instruments and similar equipment must be used in a way as to cause no annoyance or disturbance to any other member or occupancy. In particular the volume of all equipment should be controlled so as not to be audible outside any lodge between 10.00pm and 9am each day. You and your fellow guests hereby undertake to behave courteously and responsibly towards all other parties in neighbouring properties onsite, the owner and any of their staff members.

Any breach of aforesaid would be tantamount to anti-social behaviour entitling the owner to terminate the holiday let with immediate effect and take all steps as is reasonably practicable to eject you and fellow guests from the property and the site.

GOVERNING LAW 

This contract and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of Scotland .
