Please read these Terms & Conditions carefully as by booking and paying for a holiday you are deemed to have accepted them.
The contract for a short-term holiday rental shall be made between the guest and the owner. The Contract is only effective once the transaction has been approved via email, the required payment has been received and confirmation has been sent to the client either by email or post. On arrival the client must be able to provide written confirmation of booking sent to them by the owner as evidence of said booking if requested. If there is no written confirmation of booking for the appropriate dates there is no legal contract.
The Contract to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties.
This Contract relates to a “holiday let” the purpose of which is to confer on you as a holidaymaker the right to occupy our property for a holiday only. You shall not be entitled to any private residential tenancy or other tenancy, assured short hold or assured tenancy, lease, licence or other right to occupy, nor shall you obtain any security of tenure under any applicable law including but not limited to under the Private Housing (Tenancies) (Scotland) Act 2016 now or at the end of the Holiday Period. You may not sub-let the property.
A non-returnable deposit of 30% (subject to a minimum deposit of £100) of the rental is payable on booking. Provisional bookings are held for 7 working days only. The balance of the rental is payable eight weeks prior to arrival. For bookings made less than eight weeks in advance, the total amount is payable on booking.
Payment can be made by debit or credit card online using our booking system on our website, by bank transfer or by cheque. Cheques should be made payable to “A&J Orr”, trading as Elderburn Lodges, and sent to Elderburn Lodges, Denhead, St Andrews, Fife, KY16 8PA. The client is responsible for the cost of any bank charges payable. If there is any shortfall this must be paid for by the client on arrival. In the event of the failure to submit the balance eight weeks prior to the date of entry we will cancel your booking and retain the non refundable deposit.
We reserve the right to amend the price and conditions detailed on the website at any time prior to booking and variations may apply from the published price if there are any golf or other major events on locally.
VAT at the current rate is included.
If guests were to fall ill and be unable to travel home, resulting in an extended stay beyond the original booking dates the guests will be responsible for paying for the additional nights in full, on a pro-rata rate. Payment for these nights must be made immediately.
In the event that you are required, in accordance with guidelines imposed by the UK and Scottish Governments in relation to the disease known as coronavirus disease (Covid-19) and the virus known as severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)), to self-isolate at the property you will be responsible for the cost of (i) any additional nights out with the Holiday Period and (ii) rehousing any booked guests that are displaced as a result of the additional nights required by you in an equivalent property.
In the event that you have to cancel, our cancellation policy is as follows
Your lodge will be ready for you by 4pm on the day of arrival and must be vacated not later than 10am on the day of departure. Early arrival and later departure are by prior arrangement only. Please note that late departure will incur a charge of £45 per hour, which will be charged to your credit/debit card.
We will be available on site to meet you between the hours of 4pm and 6pm on your arrival date. If arriving outside of these times please contact us as soon as possible to advise, and to make alternative arrangements for keys to be collected.
We cannot be held responsible for properties not being ready for occupation should clients arrive earlier than 4pm.
Changeover days for weekly stays are normally on Fridays. Changeover days for three-night or four-night breaks are normally on Mondays and Fridays. Some peak dates are limited to seven-night minimum stays. Other durations may be arranged on request where possible within 21 days of arrival.
The number of persons occupying a property must not exceed the maximum number stipulated and agreed on at the time of booking. We reserve the right to terminate the hire without notice if this condition is breached. Children over the age of 2, not sleeping in a travel cot, count towards the total number of guests.
Guests are welcome to visit but must not stay overnight.
Charging electric vehicles via a cable direct from any property is strictly prohibited and is considered a breach of our insurance terms. Should any damage be caused as a result guests will be charged at full commercial rates.
For guests staying in lodges with hot tub facilities the specific instructions for use of the hot tub must be adhered to. If the equipment has not been used in accordance with the specific guidelines provided within the lodge then a cost will be incurred for cleaning and maintenance. THE HOT TUB MUST NOT BE USED AFTER 11PM. No glass objects or bottles are permitted in or near the vicinity of the hot tub. If any broken glass is found in or near the hot tub this will require a full overhaul of the hot tub and its components and the guest will be responsible for all costs incurred. If the hot tub needs to be shut down due to misuse this will incur a £75 charge to refill it and it will be out of use until it is back up to temperature. Any damage caused to the hot tub or its working parts due to the negligence of the client will be paid for by the client.
Guests are reminded that all of the lodges are strictly non-smoking to ensure the comfort of all our guests. All traces of smoking must be removed from patios/gardens etc by the hirer by the end of their occupancy. Anyone found to have been smoking in the lodges will be charged a fee of up to £200 for a deep clean to remove the smell of smoke for future guests.
You must ensure the property is securely locked when not occupied by you.
Your lodge must be left reasonably clean and tidy on departure.
We reserve the right to make an additional charge of the extra cost of cleaning incurred by us if the property is not left in a satisfactory condition.
Guests are expected to use lodges with care and will be liable for any loss or damage to a lodge or contents regardless of whether this damage is the result of negligence or of acts committed by themselves or by other guests.
We reserve the right to carry out inventory and other checks prior to your departure, or to carry out repairs or maintenance.
We reserve the right to seek compensation for any damage discovered at a later date.
Lit candles are NOT permitted.
Please inform us as soon as possible if you have a complaint with your accommodation or if you find that anything is faulty within the accommodation that needs our attention, so that we can assist and repair or make alternative arrangements. Due to the limited period of hire, it may not be possible to repair such items during the period of hire.
We cannot be held liable for a breakdown of any facility which is beyond our reasonable control (e.g. breakdown or failure of any electrical equipment, facility or plumbing) or from any misuse or negligence of the client using the equipment.
On departure, failure to return lodge keys will incur a charge of £45.00 per key to your credit/debit card.
We will hold credit card details in lieu of a refundable security deposit, or ask for payment of the security deposit with the balance of rental. This is held in case of unreported breakages, loss or damage to items within the property together with any excess cleaning or refuse disposal required after occupancy.
No pets or animals are permitted on the premises with the exception of registered assistance dogs in Lodge 6 only. This must be approved in advance and an additional charge applied. Anyone found to have pets in lodges will be charged a fee of up to £200 for a deep clean for the comfort of future guests.
Our prices include the provision of quality bed linen, duvets, towels and electricity. We also provide a small supply of washing powder, dishwasher powder, washing up liquid and all the basic cleaning items that you would require during your stay.
Your lodge is fully serviced for your arrival. If you wish to have additional servicing during your stay this can be arranged for an additional charge. Please contact us prior to your arrival should you wish to arrange this.
A travel cot is available at a cost of £15 per week and a high chair at £10 per week and must be requested at time of booking. Due to our limited number of cots and high chairs we cannot always guarantee availability. Please note that cot linen is not supplied.
We, our employees, contractors, cleaners and other representatives shall not be liable to guests for loss or damage to property howsoever arising. Guests must take all necessary steps to safeguard themselves and their property. Nothing in this clause shall exclude or limit any liability that we are unable to limit or exclude by applicable law, such as liability for death or personal injury caused by our negligence.
Your vehicles and their accessories and contents, and any property and valuables you bring with you are left entirely at your own risk.
At the time of booking you will be given the name of the property reserved for you. However, the owners reserve the right to move you to another property with the guarantee that it will be of the same size or larger.
If for any reason a lodge has been rendered unsuitable for holiday letting (e.g. water damage/fire damage, break down of heating system etc.) on the date booked, we will endeavour to offer alternative accommodation or alternative dates, or offer a refund of all monies paid by the client. There shall be no further claim against the owner.
The use of drones is not allowed without our express written permission.
Fireworks are not allowed without our express written permission.
Night lanterns are expressly forbidden as they are a fire hazard and can cause death or injury to local livestock
No lodge shall be used for any illegal or immoral purpose or for any trade or business.
No inflammable or explosive material should be stored or placed in or close to any lodge.
Only the curtains and blinds in each lodge shall be used to cover or obstruct the windows of the lodge.
Home entertainment equipment, musical instruments and similar equipment must be used in a way as to cause no annoyance or disturbance to any other member or occupancy. In particular the volume of all equipment should be controlled so as not to be audible outside any lodge between 10.00pm and 9.00am.
Cars must be parked only in designated parking areas for the appropriate lodge or any other building. Each lodge has a parking space for TWO cars.
We reserve the right to decline accommodation and to require the immediate removal of any persons not complying with these conditions or for any behavior detrimental to the property or the comfort of our other guests.
We retain information collected by us and may use it to provide you with holiday or special information. We will never pass your information on to third parties.
Every effort has been made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return (and to recommend us to your friends!). We live nearby, and will do our best to resolve any problem.
